Does Arizona Defensive Driving Lower Insurance?

Arizona defensive driving does not guarantee a lower insurance premium. For an eligible driver without a commercial driver license (CDL), successful ticket diversion dismisses the selected citation and keeps it off the Arizona Motor Vehicle Division (MVD) driving record. A.R.S. Section 28-3394(A) (4)

A qualifying CDL holder receives different record treatment and a specific insurance protection, explained below. Arizona also permits insurers to offer a separate reduction for insured drivers at least 55 years old who complete a qualifying course. That reduction is optional and has its own course requirements. A.R.S. Section 28-3394.01 (5); Section 20-262 (1)

For Arizona defensive driving insurance questions, start by deciding whether you need a ticket outcome or a course-based policy discount.

General information only: This article explains Arizona’s statewide framework, not an individual insurer’s rating decision. Your court controls ticket diversion, and your insurer controls its filed policy discounts and premium calculation.

Which course matches your insurance goal?

Ticket diversion changes the outcome of an eligible citation. The age-55 insurance course may qualify you for an insurer-offered reduction. Use the table to identify which path to ask about.

SituationWhat Arizona law currently supports
You successfully complete eligible ticket diversionFor a driver without a CDL, the court dismisses the selected citation and MVD does not include it on the driving record. This does not promise a lower premium. Section 28-3394(A) (4)
You hold a CDL but qualified while driving a noncommercial Class D or M vehicleThe citation is recorded, but MVD or another Arizona state agency may not use it to decide suspension or revocation. A private-passenger liability insurer must treat it as equivalent to a dismissed citation. A commercial-vehicle insurer may still consider it for a policy covering that vehicle. Section 28-3394.01 (5)
You are at least 55 and complete a qualifying driver-improvement courseAn insurer may offer an additional reduction if the exact course satisfies A.R.S. Section 20-262 and its filed rules. The statute does not promise a percentage. Section 20-262 (1)
You complete a generic online safety courseDo not assume it qualifies for either path. Court diversion uses Supreme Court-certified schools; the age-55 provision requires an MVD-approved, non-self-instructed course with actual classroom or field-driving instruction. Judicial Branch (6); Section 20-262 (1)

Arizona Has Two Different Insurance Paths

Path 1: Defensive-driving diversion for a ticket

Arizona’s court-authorized Defensive Driving Program is a diversion process. You take a Supreme Court-certified course for one eligible citation, complete it within the court’s time, and receive the statutory case outcome.

Under A.R.S. Section 28-3394 (4), ordinary successful completion does two things:

  • the court dismisses the civil or criminal traffic citation for which you attended; and
  • MVD does not include that citation on your driving record.

The Arizona Judicial Branch (6) also explains that an eligible violation is dismissed, is not included on the driving record and receives no license points. CDL holders follow the separate record rule below.

The course is not an unlimited repeat option. Under A.R.S. Section 28-3392 (3), a person who uses the program cannot attend again for a violation dated within 12 months of the last violation for which attendance was authorized. The Arizona Judicial Branch FAQ (7) clarifies that the window runs from violation date to violation date. Use those dates to check eligibility.

Section 28-3394 specifies the citation and record outcome. It does not award an insurance discount or calculate a new premium. Ask your insurer how the disposition affects your policy.

If you are trying to separate a current point count from how long information remains visible, see how long points stay on a driving record. Arizona diversion prevents the ordinary record entry for the selected citation; it is not a post-conviction point-removal course.

Path 2: A possible age-55 policy reduction

A.R.S. Section 20-262 (1) addresses a separate driver-improvement course for insurance. It says an Arizona motor-vehicle liability insurer may provide an additional rate reduction on personal-injury and property-damage coverage to an insured who:

  • is at least 55 years old;
  • completed the qualifying course within the last three years;
  • used a course approved by the Motor Vehicle Division of the Arizona Department of Transportation (ADOT);
  • used a course that includes classroom instruction or practice driving for at least the minimum hours required by the ADOT director under subsection (A)(2)(b);
  • used a course that provides actual classroom or field driving instruction for the minimum hours required by ADOT under subsection (A)(2)(c);
  • did not use a self-instructed course; and
  • received a completion certificate.

An insurer can choose whether to offer this benefit because the statute says may. It sets no discount percentage.

Two Arizona paths: eligible ticket diversion gives the non-CDL dismissal and no-MVD-record result; a qualifying age-55 course may earn an insurer-offered reduction
Ticket diversion does not guarantee a premium discount. The separate age-55 reduction is optional; confirm the exact course and insurer requirements before paying. CDL holders follow separate record rules described in the article.

A dismissed ticket does not guarantee a cheaper renewal

A discount changes the policy calculation under an insurer’s rating plan. Ticket diversion changes the legal and record outcome of one eligible citation.

The Arizona Judicial Branch FAQ (7) lists “Your insurance rate does not go up” as a program benefit. Read alongside Section 28-3394 (4), that describes protection from a citation-related increase: the ticket stays off an ordinary driver’s MVD record.

Other policy factors can still change the total premium. The statute does not guarantee that the total will stay the same or fall. CDL holders have the separate insurance protection below.

The diversion statute promises dismissal and no MVD record entry for eligible drivers without a CDL. It does not guarantee that:

  • your premium will decrease immediately;
  • your next renewal will be cheaper;
  • an existing surcharge from another event will disappear;
  • an accident, claim, lapse, or other conviction will be ignored;
  • a general rate increase will not affect the bill; or
  • the insurer will add a separate course-completion discount.

To find out whether the ticket affected your bill, ask the insurer to explain its treatment of that citation separately from other policy changes.

The CDL Insurance Rule Is Different

A CDL holder may qualify for diversion when the cited trip involved a vehicle requiring only a Class D or Class M license, the vehicle was not being used for commercial purposes, and the driver meets the other eligibility rules. These conditions come from A.R.S. Section 28-3392(A)(2)(b) (3).

In that situation, the court sends a judgment record to MVD and the violation appears on the driving record under Section 28-3394.01(A) (5).

The same subsection bars MVD or another Arizona state agency from considering that violation when deciding whether to suspend or revoke the license. The Judicial Branch FAQ (7) also says no points are assessed after successful completion, while MVD may direct the driver to Traffic Survival School depending on the violation code.

After successful completion, A.R.S. Section 28-3394.01(B) (5) provides these protections:

  • the court may not impose a civil penalty for the citation used for the course;
  • a private-passenger motor-vehicle liability insurer must consider the citation equivalent to a citation dismissed under Section 28-3394; but
  • an insurer of a commercial motor vehicle may consider the citation for underwriting and rating a policy that covers that vehicle.

If you hold a CDL and have both personal and commercial coverage, ask each insurer about the correct statutory treatment. Do not assume that the private-passenger protection erases the MVD entry or controls an employer’s decision, a federal commercial-driving rule, or a commercial-fleet policy.

Ask your insurer to confirm the age-55 course before paying

The Arizona Supreme Court (6) certifies defensive-driving schools used for ticket diversion. Section 20-262(A)(2) (1) instead calls for an MVD-approved driver-improvement course with actual classroom or field-driving instruction and expressly excludes a self-instructed course. Approval for ticket diversion does not establish approval for this insurance benefit.

An online Arizona diversion course can be valid for an eligible citation while still failing the stated conditions for the separate age-55 insurance provision. Likewise, a mature-driver course offered for insurance purposes does not automatically dismiss a ticket.

Ask the insurer:

  1. Does this policy offer a reduction under A.R.S. Section 20-262?
  2. Which named insured or rated driver must complete the course?
  3. Which exact MVD-approved courses and delivery formats qualify?
  4. Which coverages receive the reduction?
  5. What percentage or dollar amount applies under the filed rating plan?
  6. When does the reduction begin and end?
  7. When must the completion certificate be submitted?
  8. Can the benefit coexist with other discounts on this policy?

Ask for the answer in writing or request the applicable policy or rating-rule description. A.R.S. Section 20-451(A) (2) bars premium reductions that are not specified in the policy except to the extent an applicable filing provides for them.

Use This Two-Path Insurance Worksheet

Complete only the path that matches your goal. If both apply, keep the courses and certificates separate until the insurer confirms otherwise.

Save the citation disposition, course certificate, submission confirmation, and the policy document showing any reduction. These records make it easier to correct a reporting or billing problem.

What to Check at Renewal

Do not judge the course result from the total premium alone. Compare the old and new policy carefully.

Ask the insurer to separate:

  • the treatment of the diverted citation;
  • any age-55 course reduction;
  • surcharges from other convictions or crashes;
  • driver or vehicle changes;
  • coverage-limit or deductible changes;
  • lost or newly added discounts; and
  • companywide or territory rate changes.

If the bill rose, that does not prove the dismissed citation was rated. If the bill fell, that does not prove the court course created a discount. Request the specific rating explanation.

For ordinary diversion, verify that the court recorded successful completion and dismissal. If a citation that should have been excluded appears on the MVD record, use the court and MVD correction process rather than asking the insurer to reinterpret an incorrect record.

Frequently Asked Questions

Does Arizona defensive driving give an insurance discount?

The ticket-diversion course does not create a guaranteed statewide discount. For an eligible driver without a CDL, successful completion dismisses the selected citation and keeps it off the MVD record. CDL holders follow the special rule explained above. A separate age-55 statute permits insurers to offer a reduction for a qualifying MVD-approved course. Section 28-3394 (4); Section 28-3394.01 (5); Section 20-262 (1)

Will my insurer see an Arizona ticket after defensive driving?

For an eligible driver without a CDL, Section 28-3394 says MVD will not include the successfully diverted citation on the driving record. A qualifying CDL holder follows the special recorded-judgment rule in Section 28-3394.01. Section 28-3394 (4); Section 28-3394.01 (5)

The citation does not disappear from every record. Section 28-3394(B) does not bar evidence about the citation’s issuance from being introduced in another civil or criminal proceeding. Section 28-3394(B) (4)

Can my premium still increase after the ticket is dismissed?

Yes, for reasons unrelated to that citation. The Judicial Branch FAQ (7) describes avoiding a citation-related rate increase as a program benefit. Other policy changes can still affect the total premium. Ask the insurer to identify the actual rating factors and any discounts or surcharges applied.

Is the Arizona age-55 insurance reduction mandatory?

No. A.R.S. Section 20-262 (1) says an insurer may provide it. The insured and course must meet the statute’s conditions. Ask the insurer about its additional eligibility rules, reduction amount, covered policy components and processing requirements.

Does an online Arizona defensive-driving course qualify for the age-55 reduction?

The age-55 statute (1) requires an MVD-approved course with actual classroom or field-driving instruction and says the course cannot be self-instructed. Confirm that the exact course and format meet those conditions and the insurer’s rules before enrolling.

Does Traffic Survival School lower insurance?

MVD explains (8) that Traffic Survival Schools are licensed by MVD and separate from the Supreme Court’s Defensive Driving Schools. Completion does not by itself establish a Section 20-262 discount. Ask the insurer whether the exact course qualifies under its filed rules.

Should I send my diversion completion certificate to the insurer?

Ask the insurer what documentation it needs. For the ticket path, the central legal result is the court disposition and MVD record treatment. For a claimed age-55 reduction, Section 20-262(A)(2)(d) (1) expressly requires a course-completion certificate.

Keep proof of the result you asked for

For ticket diversion, keep the court disposition and check any record issue with the court and MVD. For an age-55 reduction, retain the qualifying course certificate and the insurer’s confirmation of the benefit. Use the worksheet when you call, and keep the policy document showing whether the reduction was applied.
